REVIEW OF CORRESPONDENCE

1.      Burlington Co. Freeholders – Park Grants – Clerk Picariello noted there would be additional monies allocated in the Counties 2020 budget and another round of grants offered to those Municipalities that applied in October 2019.

 

2.      Burlington Co. Joint Insurance Fund – 2020 OSB, Wellness and EPL/CYBER Funds – Clerk Picariello noted the funding available from the Burlington County Joint Insurance fund.

 

ENGINEER’S REPORT -

Engineer Hirsh was not present this evening but had submitted a written report.  The NJDEP annual stormwater report would be due May 1st.  The FY2016 Municipal Park grant project was still awaiting the contractor to paint the fence and noted the light replacement was not in yet.  The FY2015/2016 NJDOT project was completed.  The FY2018 NJDOT project was nearing completion.  The FY2019 NJDOT project close out documents were being submitted to the DOT.  The 2020 NJDOT project surveying should begin at the end of the week.

ORDINANCE – INTRODUCTION

2020-02           AN ORDINANCE OF THE TOWNSHIP OF NORTH HANOVER, COUNTY OF BURLINGTON, STATE OF NEW JERSEY AMENDING AND REVISING CHAPTER 16, §16-200, “LOT USE” OF THE TOWNSHIP CODE AND SPECIFICALLY §16-200.1 (C), “POULTRY OR LIVESTOCK SHELTER

ORDINANCE NO. 2020- 02

 

AN ORDINANCE OF THE TOWNSHIP OF NORTH HANOVER, COUNTY OF BURLINGTON, STATE OF NEW JERSEY AMENDING AND REVISING CHAPTER 16, §16-200, “LOT USE” OF THE TOWNSHIP CODE AND SPECIFICALLY §16-200.1 (C), “POULTRY OR LIVESTOCK SHELTER”

WHEREAS, the Joint Land Use Board of the Township of North Hanover unanimously recommended that Chapter 16, § 16-200.1 (C), “Poultry or Livestock Shelter” of § 16-200 entitled “Lot Use” be amended by reducing the setback from 100 feet to any lot line to 25 feet to any lot line; and

WHEREAS, the Township Committee agrees with the recommendation of the Joint Land Use Board and desires to amend this section of the Township Code accordingly.

NOW THEREFORE BE IT ORDAINED by the Township Committee of the Township of North Hanover, in the County of Burlington, State of New Jersey, that the Chapter 16, §16-200.1 (C) entitled “Poultry or Livestock Shelter” be and is hereby amended as follows (deletions have strikethrough; additions are bolded and underlined):

 

SECTION 1. § 16-200.1 C. Poultry or Livestock Shelter is hereby amended as follows:

 

C. Poultry or Livestock Shelter. No poultry or livestock shelter shall be erected nearer than one hundred twenty-five feet to any lot line.

 

SECTION 2.            At least three copies of said full Ordinance are on file in the Office of the Municipal Clerk for public examination and acquisition. Copies are available for inspection or acquisition during regular weekday working hours and arrangements have been made for the publication of said proposed Ordinance in pamphlet or other similar form which will be available for purchase from the Township Clerk.

 

SECTION 3.            This ordinance shall take effect upon final passage and publication according to law.

 

SECTION 4.            The Township Clerk is hereby directed to give notice at least ten days prior to the hearing on the adoption of this Ordinance to the County Planning Board, and to all others entitled thereto pursuant to the provisions of N.J.S. 40:55D-15. Upon adoption of this Ordinance, after public hearing thereon, the Township Clerk is further directed to publish notice of passage thereof and file a copy of this Ordinance as finally adopted with the County Planning Board as required by N.J.S. 40:55D-16 and with the Township Tax Assessor.

 

SECTION 5.  All ordinances or parts of ordinances inconsistent herewith are hereby repealed.

 

SECTION 6.  If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions.

2020-52            Resolution Canceling Taxes

RESOLUTION CANCELING TAXES

 

            WHEREAS, the United States Department of Veteran Affairs has classified Antonio Negron as 100% Permanently and Totally Disabled; and

 

            WHERAS, by application from Donald Kosul, Tax Assessor in the Township of North Hanover, the said exemption is granted from January 8, 2020; and

 

            WHERAS, N.J.S.A. 54:4-3.30a – Allows for the exemption from taxation from real and personal property for any citizen and resident of the State who has a total or 100% permanent disability as defined by this statue.

 

            WHEREAS, the following taxes must be canceled and any monies paid by the owner should be refunded.

 

            THEREFORE BE IT RESOLVED, that the following taxes be canceled:

 

                        BLOCK 401 LOT 48                    2020 May                $1,768.08

 

THEREFORE BE IT RESOLVED FURTHER, that a copy of this Resolution be forwarded to the Burlington County Board of Taxation, the Treasurer of Burlington County, the Municipal/Regional School Board to advise them of the action taken by the Township Committee on this matter.

2020-53            Resolution Approving Blue Light Permit Application

COUNTY OF BURLINGTON

 

APPROVAL OF BLUE LIGHT PERMIT APPLICATION

 

            WHEREAS, pursuant to N.J.A.C. 13:24-5 ET Seq. an applicant for permit authorizing the use of blue emergency warning lights may be considered eligible only if the applicant is an active member in good standing of a volunteer fire company, first aid or rescue squad, or a county or municipal Office of Emergency Management volunteer whose official duties include responding to a fire or emergency call; and

.

            WHEREAS, Benjamin Weigand has met the qualification for a Blue Light Permit and it is the recommendation of the Fire Chief to approve this applicant for a Blue Light Permit.

 

            NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of North Hanover, County of Burlington, that in accordance with N.J.A.C. 13:24 et. seq. it hereby approve Benjamin Weigand for a Blue Light Permit and hereby authorizes the Mayor to execute the Blue Light Permit Application.

 

            BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to the Jacobstown Volunteer Fire Department Chief.

2020-54            Resolution Authorizing a Street Opening Permit

RESOLUTION AUTHORIZING STREET OPENING PERMIT

 

    WHEREAS, Al Davis of Public Service Electric & Gas Co., hereinafter referred to as “PSEG”, has submitted an application for a Street Opening Permit for 10 Provinceline Road; and

 

  WHEREAS, pursuant to Chapter 12 the Township Engineer, Joseph Hirsh of Environmental Resolutions Inc. has reviewed said application and recommends approval by the Township Committee; and

 

  WHEREAS, pursuant to Chapter 19 “Fees” a fee of $50 is required prior to the issuance of a Street Excavation Permit.

 

  NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of North Hanover that the application for a Street Excavation Permit to PSEG for the location known as 10 Provinceline Road(s) is hereby approved subject to receipt of payment of the applicable fee.

2020-55           Resolution Authorizing the Award of a Non-Fair and Open Contract for North Hanover Township with Herman’s Trucking, Inc. for Brush Removal Services

TOWNSHIP OF NORTH HANOVER

COUNTY OF BURLINGTON

RESOLUTION AUTHORIZING AWARD OF A NON-FAIR AND OPEN CONTRACT FOR NORTH HANOVER TOWNSHIP WITH HERMAN’S TRUCKING, INC. FOR BRUSH REMOVAL SERVICES

            WHEREAS, the Township of North Hanover has a need to acquire management and administration of the Township’s brush removal services as a non-fair and open contract pursuant to the provisions of N.J.S.A. 19:44A-20.4 or 20.5 as appropriate; and,

 

WHEREAS, the Township Committee has determined and certified in writing that the value of the contract will not exceed $17,500; and

 

WHEREAS, the Township Committee has deemed soliciting two competitive quotations is not practicable due to the uniqueness of the service required and have determined that the quote of Herman’s Landscaping, Inc. response is the most advantageous, price and other factors considered; and

 

WHEREAS, the anticipated term of this contract is for twenty-four (24) months, with a Township option to exercise two (2) one (1) year extensions; and

 

WHEREAS, Herman’s Landscaping Supply has completed and submitted a Business Entity Disclosure Certification which certifies that Herman’s Landscaping Supply has not made any reportable contributions to a political or candidate committee in the Township of North Hanover in the previous one year, and that the contract will prohibit Herman’s Landscaping Supply from making any reportable contributions through the term of the contract.

 

            NOW THEREFORE BE IT RESOLVED that the Township Committee of the Township of North Hanover authorizes the Mayor to enter into a contract with Herman’s Landscaping, Inc. effective April 1, 2030 through March 31, 2022, with the right of the Township to extend of two (2) one (1) year extensions.

 

BE IT FURTHER RESOLVED that the required “Notice of Contract Awards” shall be published in the legal newspaper as required by law within ten (10) days of its passage.

DISCUSSION

There were no discussion items this evening.

 

TOWNSHIP COMMITTEE “COMMENTS”

Committeeman O’Donnell noted the fire truck repair was complete and back in service.

 

Deputy Mayor Doyle noted baseball pictures would be March 20th.  The NBIAA fees would be approximately $6,000.00.  There was a review of previous discussions that there would be no uniform deposits.  Committeeman Kocubinski noted the concept kind of fell apart due to lack of interest.  Deputy Mayor Doyle noted moving forward shirts would be purchased and if the funding is depleted this would be revisited.  There was baseball field maintenance discussion.  Deputy Mayor Doyle inquired about the weeds.  Clerk Picariello noted this was part of the grass contract and there is a DEP certified contractor involved.  She also stated that weekly conditioning was part of controlling the weeds.  Deputy Mayor Doyle also noted the JR ROTC would be assisting with clean-up day.  He also expressed the need for rakes.  There was discussion of making use of the golf cart and using the barn.  There was inclination to have barn keys made that would have to be kept track of and ensure that the coaches are following up appropriately with raking the fields and allow the use of the golf cart.  In addition, Deputy Mayor Doyle would research storage equipment.

Deputy Mayor Doyle opened the meeting to the public.

 

Chris Powell – Recreation Advisory Committee – He noted the difficulties of trying to work through what his responsibilities are as it relates to fields.  He feels like he has been unfairly labeled a complainer and was looking for direction.  He discussed his need for access to equipment.  He expressed appreciation for the conversation because most of his questions were answered but believes there is a breakdown of communication.  Clerk Picariello noted he was welcome to contact her office with any problems he is having and she would direct his issue to the appropriate Committee member.  Committeeman O’Donnell noted if it is not brought to the Committee’s attention they cannot rectify the situation and suggested also emailing Deputy Mayor Doyle.  Deputy Mayor Doyle noted, Mr. Powell is correct; this should not be that difficult and would address the situation.  Mr. Powell stated he would just like to simplify the situation.  It was noted the only thing a coach should be responsible for is a drag net and a rake, anything beyond that was the Township’s responsibility.  Deputy Mayor Doyle noted the first action would be tilling the fields.  Mr. Powell noted his willingness to roll up sleeves and work but he needs access to the equipment.  Deputy Mayor Doyle noted this would be addressed.

AUTHORIZING A CLOSED SESSION MEETING

 

WHEREAS, the Open Public Meetings Act, P.L. 1975, Chapter 231 and P.L. 2001, C. 404, permits the exclusion of the public from a meeting in certain circumstances; and

 

            WHEREAS, the Township Committee of North Hanover Township wishes to go into a closed Executive Session and is of the opinion that such circumstances presently exist which should not be discussed in public, and

 

            WHEREAS. the Open Public Meetings Act pursuant to N.J.S.A. 47:1A-1 and N.J.S.A.  10:4-12 permits the Township Committee to discuss certain matter(s) in private, and in this case for the purpose of the Township Committee to discuss contract negotiations, litigation and personnel matters in this regard.

 

NOW, THEREFORE, BE IT RESOLVED by Township Committee of North Hanover Township that it will go into an Executive Session for the purpose of the Township Committee to discuss Contract Matters, Litigation and Personnel matters.

 

            BE IT FURTHER RESOLVED that the results of such discussion may be revealed at such time as the matter(s) are resolved and/or a contract(s) is signed and/or the negotiations are formally settled. Interested parties may contact the Township Clerk anytime during normal business hours for periodic updates as to the availability in this regard.
